XGenize LLC (doing business as XGenize) (“we,” “us,” “our”) respects your privacy. This policy explains how we collect, use, and share personal information when you use our software, visit our websites, contact us, pay us, or opt in to our email or text messages.

This policy applies to XGenize and the services we offer, including our software, websites, accounts, billing, customer support, and email and SMS messaging.

Our services are intended for use in the United States. We are a US company, and we process personal information in the United States.

Two different kinds of information

Organizations use our software and decide what information to enter about the people they do business with. We process that information so we can provide the software to the organization. The organization is responsible for having the right to provide that information and for how it uses the information.

We also collect information about our own customers and users: the people and businesses that buy or administer our software, visit our sites, contact support, or join our messaging program. This policy covers both.

Information we collect

Information you give us. When you create an account, join an organization, subscribe, or contact us, we collect details such as your name, email address, phone number, profile photo, organization, role, and the contents of your request. Sign-in may be handled by a third-party authentication service. We store the account identifiers needed to recognize you.

Payment information. If you pay for a subscription, or if an organization collects or makes payments through our software, payment card and related billing details are processed by our payment processors. We receive limited billing information, such as a customer identifier, card brand, last four digits, expiration, and transaction status. We do not store full card numbers on our own systems.

Information organizations enter. Organizations may submit identity and contact details, records related to the services they provide, files, and other information they choose to store in the software. That information can include sensitive details. What we hold depends on the service and on what the organization enters.

Location. If a feature you use asks for device location, we collect it to provide that feature. You can control location access in your device settings.

Messages. If you opt in to email or SMS from XGenize, we collect your name, email address or phone number, your consent (including when and how you opted in), messages you send us such as STOP or HELP, and delivery records. Email consent and SMS consent are separate. Agreeing to receive messages is not a condition of any purchase.

Information collected automatically. When you use our websites and apps, we collect technical information such as IP address, browser and device type, operating system, dates and times of access, pages or screens you use, and diagnostic logs. We use cookies and similar technologies to operate the services, keep you signed in, remember preferences, and protect the services. We do not sell personal information.

How we use information

We use personal information to:

  • Provide, operate, and secure the software and websites

  • Create and manage accounts, organizations, and permissions

  • Process subscriptions, invoices, and other payments

  • Provide customer support and respond to requests

  • Send service messages about your account, billing, or a request you made

  • Send email or SMS you opted in to receive, and honor unsubscribe and STOP requests

  • Keep records of consent, opt-outs, and transactions

  • Detect fraud, debug problems, and enforce our agreements

  • Comply with law and respond to legal process

  • Understand how the services are used so we can maintain and improve them

We use sensitive information only to provide the services an organization requested, to secure the services, and to comply with law. We do not use that information to market to the person the record is about.

If we have a separate agreement with an organization, that agreement also governs how we handle information the organization enters.

How we share information

We do not sell personal information. We do not share it with third parties for their own marketing.

We share information in these cases:

  • With the organization that uses our software, and with the people that organization authorizes, so they can use the service.

  • With service providers that process information for us under contract, and only for the work they do for us. These include cloud hosting, authentication, payment processing, email and SMS delivery, and customer support tools. They may not use that information for their own marketing.

  • With payment partners when an organization uses our software to collect or make payments.

  • If the law requires it, such as a subpoena, court order, or other legal process, or when we need to protect the rights, property, or safety of XGenize, our customers, or others.

  • In connection with a merger, sale of assets, financing, or acquisition of all or part of our business. We will require the recipient to handle personal information in line with this policy.

Mobile opt-in data and consent are not shared with third parties or affiliates for marketing or promotional purposes. Vendors that send SMS for us may receive a phone number and related consent records only as needed to deliver those messages. Email opt-in data and consent are treated the same way. Any other sharing described in this policy excludes mobile opt-in data and consent, except for a disclosure required by law.

How long we keep information

We keep personal information for as long as we need it to provide the services, and then for as long as needed to meet legal, tax, accounting, and security obligations, to resolve disputes, and to enforce our agreements.

Information an organization entered is kept for the life of that organization’s account, unless the organization deletes it or our agreement says otherwise. Backups may hold a copy until the backup cycle removes it.

If you opt out of email or SMS, we keep the address or phone number on a suppression list so we do not message you again. We also keep records of your consent and your opt-out for as long as we need them to honor your choice and to meet our legal obligations.

How we protect information

We use administrative and technical safeguards designed to protect personal information, including access controls and encryption in transit. No method of transmission or storage is completely secure.

Children

Our services are built for businesses and are not directed to children under 13. We do not knowingly collect personal information directly from children under 13. An organization may store information about a minor in our software. That organization is responsible for having the authority to do so. If you believe we have collected personal information directly from a child under 13, contact privacy@xgenize.com and we will delete it.

Your choices and rights

Account information. You can review and update much of your account information in the service. You can also email privacy@xgenize.com to ask us to access, correct, or delete personal information we hold about you. We may need to keep some information where the law allows or requires it, including records of an opt-out, invoices, and information needed for security or legal claims.

Information an organization entered about you. If an organization that uses our software entered your information, that organization controls the record. Contact them to access, correct, or delete it. If you contact us, we will refer your request to that organization or assist them as required by our agreement and by law.

Email. You can unsubscribe from marketing email with the link in the message, or by emailing support@xgenize.com. We will honor that request within 10 business days. We may still send non-marketing messages about your account, billing, or a request you made.

SMS. You can cancel text messages at any time by texting STOP, as described below.

California residents. We do not sell personal information, and we do not share it for cross-context behavioral advertising. You may email privacy@xgenize.com to request that we:

  • Tell you the categories and specific pieces of personal information we collected about you, the sources, the purposes, and the categories of third parties we disclosed it to

  • Correct inaccurate personal information

  • Delete personal information, subject to exceptions allowed by law

We will not discriminate against you for exercising these rights. We will verify your request by matching it to information we already have, or by contacting you at an email address or phone number you gave us. You may use an authorized agent if the agent provides proof of authorization. If we cannot verify the request, we may ask for more information, and we will delete that extra information after verification.

Other US state privacy laws may give you similar rights. You can use the same email address to make a request.

Text and email messaging

This section applies when you opt in to receive email or SMS from XGenize. The program is intended for recipients in the United States. Messages are sent from (855) 943-6493.

  1. The messaging program may consist of general customer care messaging to answer questions and provide support, and marketing messaging that includes discount codes, special deals, or texts promoting our products and services, depending on which program(s) you opt in to. We will only send content you have explicitly signed up to receive. Message frequency varies by the program you join and by the description shown when you opt in.

  2. You can cancel the SMS service at any time. Text STOP to the phone number from which you received messages. After you send STOP, we will send you a message to confirm that you have been unsubscribed. After that, you will no longer receive SMS messages from us. If you want to join again, sign up as you did the first time and we will start sending SMS messages to you again.

  3. If you are experiencing issues with the messaging program, reply HELP for more assistance, or contact us at support@xgenize.com.

  4. Carriers are not liable for delayed or undelivered messages.

  5. Message and data rates may apply for any messages sent to you from us and to us from you. If you have questions about your text plan or data plan, contact your wireless provider.

  6. Questions about this messaging program or about privacy can be sent to privacy@xgenize.com or support@xgenize.com.

Changes to this policy

We may update this policy from time to time. The date at the top of this page will change when we do. If we make a material change, we will post the updated policy here and, where appropriate, notify you by email or through the services.
